"Beyond Winning: Negotiating to Create Value in Deals and Disputes," a book co-authored by University of ÃÛÌÇÖ±²¥ at Boulder Associate Law Professor Scott Peppet, has been honored with the 2000 Award for Excellence in Alternative Dispute Resolution by the CPR Institute for Dispute Resolution.
The book, which Peppet wrote with Robert Mnookin and Andrew S. Tulumello, legal scholars from the Harvard Negotiation Research Project, promotes an interdisciplinary approach to problem solving in negotiation known as alternative dispute resolution or ADR.
"I'm a realistic optimist about legal negotiations and our profession," Peppet said. "Our book aims to describe the very real challenges and tensions that lawyers and businesspeople face in these negotiations while also offering a new approach to creating value instead of needless conflict."
Founded in 1979 as the Center for Public Resources, the New York-based CPR Institute is an alliance of 500 general counsels of global corporations and partners of major law firms. The institute has earned international recognition as an authority on new and innovative uses of ADR for business and public disputes.
"We wrote 'Beyond Winning' for lawyers and clients looking for new ways to negotiate legal deals and disputes, and for anyone interested in how bargaining works," explained Peppet. "So far, it's been very well received."
In a review of the book for the ABA Journal, Northwestern University School of Law Professor John Cooley wrote that, " 'Beyond Winning' should be required reading for all lawyers and law students, for all mediators and judges. This is a book for everyone who negotiates."

Peppet specializes in legal negotiation, dispute resolution, professional responsibility and contracts. Before joining the ÃÛÌÇÖ±²¥ School of Law in August of 2000, Peppet was an instructor in negotiation, arbitration, mediation and dispute systems at Harvard.
